Data retention under LSSI

Under Ley 34/2002 del 11 de julio de Servicios de la Sociedad de la Información y de Comercio Electrónico (LSSI), NAJUAL BROTHERS, S.A., in its capacity as provider of a data hosting service, will retain your information for no more than 12 months, insofar as such information is essential for identifying the origin of the hosted data and when service started. Retaining such data has no bearing on the secrecy of communications and such data may solely be used as part of a criminal inquiry or for public safety purposes by being disclosed to the competent judges and/or courts or Ministry.

Please note that we may have to disclose your data to law enforcement agencies under personal data protection regulations.

NAJUAL BROTHERS, S.A. is the owner of all copyrights, intellectual and industrial property rights, know-how, and all such rights as may be related to the contents of our website https://najual.com, the services offered through our website, the software required for implementation purposes, and all related information.

You may not reproduce, publish and/or use the contents of our website https://najual.com, either in their entirety or in part, without our prior, written consent, unless you do so for strictly private purposes.

Intellectual property rights relevant to software

You agree to respect the rights relevant to any third-party software that NAJUAL BROTHERS, S.A. may make available to you, including software that is free and/or publicly available.

NAJUAL BROTHERS, S.A. is entitled to use, and has the necessary intellectual property rights on, the software.

Hiring our services does not entail acquisition of any rights or license on software required for service delivery or any technical service monitoring information, with the exception of the rights and licenses necessary to provide the services under contract and solely while the services are being provided.

In relation to actions beyond the scope of the contract, you must secure the consent of NAJUAL BROTHERS, S.A. in writing. You are not allowed to access, alter, or visualize the settings, structure and filing systems of servers owned by NAJUAL BROTHERS, S.A. You further agree to assume any and all civil or criminal liability that may arise from a failure of the servers and security systems resulting from negligent or willful misconduct on your part.

Intellectual property rights relevant to hosted contents

Any use violating any intellectual property rights connected with services provided by NAJUAL BROTHERS, S.A. is prohibited, and more particularly:

• Any use that may be in violation of the laws of Spain or infringe the rights of a third party.
• Publishing or conveying content that NAJUAL BROTHERS, S.A. may consider to be violent, obscene, abusive, illegal, racial, xenophobic, or defamatory.
• Cracks, software series numbers or other content violating the intellectual property rights of a third party.
• Collecting and/or using personal data of other users without their express consent or in violation of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
• Using the domain email server and email addresses for sending unsolicited bulk mail.

You are fully responsible for the content of your website, any information you may convey and store, hypertext links, third-party claims and legal actions in relation to intellectual property, third-party rights, and the protection of minors.

You are responsible for complying with any and all laws and regulations in force and any and all rules pertaining to the operation of online services, e-commerce, copyrights, public order, and universal principles governing the use of the Internet.

Secure hosting

NAJUAL BROTHERS, S.A. makes back-up copies of all data hosted in its servers. However, we do not assume any responsibility for the loss or accidental deletion of data by users. Likewise, we do not guarantee total recovery of data deleted by users, since said data may have been deleted and/or altered since the last back-up copy was made.

With the exception of back-up services proper, our services exclude the recovery of data hosted in back-up copies made by NAJUAL BROTHERS, S.A., should the loss have been caused by the user. In such case, a fee will be agreed upon based on the complexity of the recovery operation and amount of data to be restored, prior acceptance by the user.

The recovery of deleted data is included in the service fee solely if data are lost for causes attributable to NAJUAL BROTHERS, S.A.

Marketing communications

Under LSSI, NAJUAL BROTHERS, S.A. will not send you advertising or marketing communications by email, or other equivalent electronic means, which you have not previously requested or expressly authorized.

If we had a contractual relationship with you in the past, NAJUAL BROTHERS, S.A. will be authorized to send you marketing communications in relation to our products or services that are similar to those you originally hired.
